Eligible Survivor(s) - means upon your death, your unmarried child (or unmarried children) who was, at the date of your death, dependent on you for support and who is: (a) under the age of 18, or (b) if between the ages of 18 and 25, in full-time attendance at an educational institution acceptable to Revenue Canada. Such an individual shall cease to be considered an "Eligible Survivor" upon marrying or upon ceasing to meet the criteria in either (a) or (b) of this definition. Spouse - means upon your death: (a) a person who is cohabiting with you in a conjugal relationship, having so cohabited for a period of one year, or (b) if there is no person to whom (a) applies, a person who is married to you or is a party to a void marriage with you. The definition of Spouse is subject to any meaning assigned by a provincial property law to you regarding distribution of benefits in the event of marriage breakdown, provided that such law does not extend beyond the meaning assigned under the Income Tax Act (Canada).
